  1. Colourings and Ingredients

***ALLERGY WARNING***:

***Please be aware that whilst your chosen cake may not be made with nuts; nut products or other allergens, it will be prepared in a kitchen where these products may be used in other cakes and fillings. Please note that we handle all allergens in our kitchen and cannot guarantee our food is free from these. Please highlight any allergies of those who will be consuming/handling the cake, at the time of ordering. Your safety is our greatest concern, and we would ask you to think carefully about the risks before you order***

I cannot guarantee to match up the exact colours and designs you have chosen since every cake is handmade by me in my kitchen and may vary despite every effort being made to match your original design.

Some of the elements on your cake may contain wires, dowels, jewels, and other non-edible products.

These will only be used if essential to the design/construction and will be highlighted to you on collection/delivery. Once highlighted it is yours or your caterer’s responsibility to ensure that these non-edible products are removed before serving the cake to yourself or your guests.

Alternatively, we can design a fully edible cake which does not need any structural support or wires.

  1. Damage & complaints

Once the cake has been collected/delivered and signed for, SOBO Sweet Stuff Cakes cannot be held responsible for any interference or damage to the cake. All my cakes are fragile, particularly some toppers and decorations and they require careful handling.

If the client claims there is a problem with the cake, please be aware that there is a ‘no cake, no refund’s’ policy. In this event, SOBO Sweet Stuff Cakes requires the cake to be returned in full to investigate the claim, before any refunds can be considered.

A taste is a very personal matter and subjective and returns/refunds will not be accepted for this reason. Any refunds are at the discretion of SOBO Sweet Stuff Cakes.

  1. Retainers

All orders require a retainer of the total cost which will become due once the order has been placed and details checked and agreed by you with the remaining balance due on collection/delivery of the cake. This deposit can be made via bank transfer or cash. The retainer is essential to confirm an order.

  1. Cancellation Policy

If for any reason it is necessary for you to cancel your cake order sadly the retainer will not be able to be refunded.

If for any reason I am unable to complete the order, SOBO Sweet Stuff Cakes will be limited to refunding your retainer in full. No other payments will be made in this event. I will always work to meet an order, however in certain circumstances (for example illness) it would be irresponsible to do so.

  1. Change of Date

If for any reason you wish to re-arrange the date your cake is required, I will try my best to accommodate these changes without any additional charges provided sufficient notice is given and that I am able to provide a cake for the re-arranged date. However, if I am fully booked on your new date and cannot provide the cake, it will not be possible to refund your 50% retainer.

  1. Publication and Promotional Rights

By signing the Order Form the client hereby agrees that SOBO Sweet Stuff Cakes is the sole designer and owner of the final cake design. All cake designs used by SOBO Sweet Stuff remain the property of SOBO Sweet Stuff Cakes.

The client has no ownership rights over any cake design. I reserve the right to re-use and publish our photographs of the client's cake as and when required.

Whilst I try to ensure that all designs are exclusive to SOBO Sweet Stuff Cakes, we do not guarantee exclusivity of cake designs between our clients. The only exception to this rule is when the customer commissions an exclusive design.

  1. Ownership Rights

The relationship between the client (the purchaser of the cake) and SOBO Sweet Stuff Cakes and the ownership of the product(s) purchased by the client from SOBO Sweet Stuff Cakes are clear in law.

The client owns the cake once delivered to the venue or collected, by prior agreement with SOBO Sweet Stuff Cakes, from SOBO Sweet Stuff Cakes.

If the client fails to pay the full amount for the cake and/or products, as agreed and stated on the order form, then ownership of the products remains with SOBO Sweet Stuff Cakes and not the client.

The responsibility of ensuring the cake remains in good order lies with the owner of the cake. The transfer of ownership also equates to the transfer of responsibility. For example, when ownership of the cake is transferred to the client it becomes the client's responsibility to ensure the cake remains in good order.

An aftercare form provided by SOBO Sweet Stuff Cakes is signed on transfer of ownership to ensure that the cake is handed over in good order.

  1. Design Rights

The ownership of the 'cake design' remains with SOBO Sweet Stuff Cakes and is not transferred on ownership of the product to the client. This is important because it means that SOBO Sweet Stuff Cakes has the right to publish and sell the aforementioned 'cake design' to other clients.

During the consultation process the client may view a range of existing cake designs from photos developed exclusively by SOBO Sweet Stuff Cakes for SOBO Sweet Stuff Cakes.

The client selects a design, variation of a design or part/combinations of various designs developed by the company. This is standard practice within the industry.

  1. External Published Designs

SOBO Sweet Stuff Cakes will not make exact copies of other cake designs produced by other UK registered Cake Companies. This ensures that cakes within the industry remain exclusive to those companies; ensures that there is a large variety of 'cake designs'' available to clients and helps maintain exclusivity.

This is healthy for the industry and helps to differentiate us from the mass market.

  1. The Design Process

SOBO Sweet Stuff Cakes defines the design of a cake as the result or outcome of the consultation or design process conduct between SOBO Sweet Stuff Cakes representative and the client.

During the consultation the representative will discuss and elicit from the client a list of requirements for their cake. Once these requirements are accepted by the client an order form is written out listing these requirements.

This is signed by the client and a deposit paid. At this stage no design exists. The client has not paid for the design only the ingredients for making the design, the reservation date, and the list of requirements.

SOBO Sweet Stuff Cakes will then design a cake to meet those requirements. If the customer has commissioned an exclusive design, they may request to receive a sketch of the design to review before the production of the cake.

  1. Formal Definition of a Cake Design

A cake design is like any other designed product and has two elements to it: ‘Function’ and ‘Form’. The ‘Function’ is the first aspect of the cake design determines the 'fitness of purpose of the design.' This means that the cake has been designed to meet the requirements of the client.

These aspects of the 'cake design' do not involve the client and are the sole concern of the professional cake designer and maker.  For example, the cake will be designed to remain upright and stable for the duration of the event. The ‘Form’ of the cake is the second aspect of the design and to do with the outward impression of the cake. This means the cake has been designed to meet the visual, textual and taste requirements of the client. It is this that the customer usually understands as the design of cake. For example, the cake designer will use an appropriately sized icing nozzle to reflect the degree of delicacy required on royal icing filigree. The choice of nozzle size is a decision for the designer of the cake and the customer will not need to worry about this kind of detail.
